Subject : Direction regarding the application of consent for the Small Scale Industries.

Sir,

This has reference to the letter No. 6 (15)/90-SSI Bd. Dated September 16, 1992 regarding the follow-up on the decisions/ recommendations of the SSI Board Meeting held on 24.8.1992. The Central Governments has issued a direction on September 12, 1992 to the Central Pollution Control Board under which the procedure for making an enquiry on an application seeking consent, given in rule 10 of the Air (Prevention and Control of Pollution) UT Rules, 1983 and Rule 33, of water(Prevention and Control of Pollution) Rules, 1976 shall be implemented in respect to categories of Small Scale Industries, characterized as heavily polluting industries. These are:-

  1. Fertilizer (Nitrogen/Phosphate)

  2. Sugar

  3. Cement

  4. Fermentation and Distillery

  5. Aluminum

  6. Petro Chemicals

  7. Thermal power

  8. Oil refinery

  9. Sulphuric Acid

  10. Tanneries

  11. Copper Smelter

  12. Zinc Smelter

  13. Iron & Steel

  14. Pulp & Paper

  15. Dye and Dye intermediates

  16. Pesticides manufacturing and formulation

  17. Basic Drugs and Pharmaceuticals

For other categories of small scale industries, the acknowledgement by the State Pollution Control Board of the application form would serve the purpose of consent; and there would also be no need for the industry to obtain periodic renewal of consent till such time that a unit modifies/changes its process (processes).

Provided, that the State Pollution Control Board or the Committee specified by the Central Governments (for Union territories), may conduct random checks or call for information from any small scale unit, and make a formal consent order prescribing conditions etc., as required.
