Subject: - Registration of Industries/SSI units using the words 'India', 'Kerala' etc. - clarification regarding usage of the name by companies partnership firms and proprietary concerns.

Sir,

In this office letter of even number dated 10th August, 1993 on the above subject instructions were issued about the restrictions placed by the Emblem & names (Prevention of Improper Use) Act, 1950 on the usage of the name, emblem or official seal of Government of India or of any State without prior permission of the Central Govt.

In this connection, it may be mentioned that when companies get registered with the Registrar of Companies, the implications of the above Act are taken into account before registering the name of the company. Hence, in case of companies, whose name is duly registered under companies law, their name should be registered as such while giving SSI registration irrespective of whether it contains the name 'India' or of any State within or without brackets.

In case of partnership and proprietorship concerns, guidelines issued vide the above referred letter may continue to be followed.
